Calculating Child Support
Alabama uses an income shares model to determine child support, with the parent having the greater income being responsible for a larger percentage of support. The formula considers the gross income of both parents and uses the Basic Child Support Obligation schedule to determine the support for the number of children. Each parent is responsible for a percentage of this amount, based on the differences in the income of both parents. The court can deviate from these guidelines.
The court may deviate from the guidelines when:
- There is a joint physical custody arrangement
- Parents have income that is either very high or very low
- The child has special needs
- There is another reason that makes applying the guidelines inappropriate
Because there are so many variables in awarding child support, it is important to get the advice of an attorney with specific experience in this area of law. We have the experience and knowledge required to ensure that your case is handled properly. You will enjoy personal service and remain in constant communication with your attorney throughout the process.
Enforcing a Child Support Order
When a parent stops making payments or isn’t making regular payments, the Child Support Enforcement Division of the Alabama Department of Human Resources is responsible for ensuring compliance. In some situations, a change in situation may result in the need to increase or decrease child support payments. Our child support lawyers in Birmingham can help with modifications of existing orders.
